Although RoommateShop® provides an excellent source for roommates, it is your choice who you select. Your matches will be determined by your matching qualifications and what you will accept in a roommate. This service does not guarantee finding a roommate. **********************************************************

************* ROOMMATESHOP® AGREEMENT **************

I engage RoommateShop®, hereinafter may be referred to as RS, to search for referrals of people who desire to share living facilities and expenses that closely match the criteria I have provided RS. RoommateShop® service is a matching service and my choices will be limited by the following search criteria I provide: age, gender, smoking preference, children, amenities, number of roommates, sexual orientation, pets, price range, general location, couple status, date of availability, property type, and lease length. RoommateShop® does not match based on personality or occupation, however my potential roommates may provide some of this information. I understand this service does not guarantee that I will receive any referrals.

FEE(S):

PLEASE NOTE: RoommateShop® Service may require a fee to get listed. Fees vary depending on my location I am looking, whether I need a place to share or have a place to share, or the amount of time I have chosen to look. Our fees are posted here: http://RoommateShop.com/main/rentinfo/feeInformation (you can copy and paste this link into your browser) IF MY SITUATION REQUIRES A FEE: RS agrees to provide this service for one application fee, per roommate situation. All application fees, are payable in advance. I understand the fee, covers the cost of processing my application and that ONCE I SUBMIT MY APPLICATION TO ROOMMATESHOP® AND PAY THE APPLICATION FEE, ALL MONIES PAID ARE NONREFUNDABLE AND NON-TRANSFERABLE FOR ANY REASON. If I choose to pay by check, I understand there will be a $35 returned check fee plus additional cost for collections per check that is returned to RoommateShop® because of insufficient funds or if I stop payment on a check. Customer hereby acknowledges and agrees that any account that becomes delinquent will be subject to collections service. Customer agrees to pay all court costs and reasonable attorney fees for collection of all past due amounts owed, plus interest at 18% (eighteen percent) per annum on all such amounts outstanding. The fee is good UNTIL I find a roommate through RoommateShop® OR for the pre-determined amount of time I have paid for, whichever comes first.

Please ask your RoommateShop® Representative about any Promotional Specials. IF I JOIN FOR FREE (SPECIAL PROMOTIONS): Sometimes, RoommateShop® will run specials where the service is offered FREE of charge. If I join with at no charge, terms and conditions still apply, however, my file will expire in a pre-determined amount of time, depending on the special RoommateShop® is running.

PRIVACY:

RoommateShop® respects your privacy. The information you provide, your activities, and/or account information is used for the purpose of obtaining/becoming a roommate and is NOT shared with anyone outside of RoommateShop® `s referral base. I agree that RS may reveal to person(s) it considers prospective roommates all information about me including but not limited to written, oral, and photographic material that either I or RS has provided. **************

WHEN I STOP LOOKING FOR A ROOMMATE: I agree to let RS know IMMEDIATELY when I am no longer looking for a roommate. I will notify RS immediately upon finding a roommate regardless if it someone I found outside of the RS referral base. I will provide RS with the name of my new roommate. IF RoommateShop® RECEIVES COMPLAINTS FROM OTHER CUSTOMERS THAT I AM NO LONGER LOOKING FOR A ROOMMATE OR IF I FAIL TO NOTIFY RoommateShop® WITHIN 3 BUSINESS DAYS OF FINDING A ROOMMATE (EITHER ON MY OWN OR THROUGH RoommateShop®) OR STOPPING MY SEARCH, I UNDERSTAND THAT RoommateShop® HAS THE RIGHT TO CLOSE MY FILE AND I MAY NEED TO PAY AGAIN IN ORDER TO REACTIVATE MY FILE.

USE OF RoommateShop:

MY RoommateShop FILE IS FOR MY USE ONLY.

I agree that I may not transfer this service to anyone else and I will not share my referrals with anyone outside of the RoommateShop service. In the event that I do allow others outside of the RoommateShop® referral base to use my referrals to find a roommate of their own, this will be considered theft of service; I agree that my file will be permanently closed and I will not receive a refund.

RS reserves the right to cancel service to me for any reason RS deems appropriate with no application fee refund. Some reasons will cancel service include but are not limited to: Inconsistencies, untruths, attempts to defraud or harass RS and/or its clients, attempting to use this service for reasons other than finding a roommate, behavior in which RS deems inappropriate or inconsistent with finding a roommate, or failure by me to notify RS after having found a roommate (through RS or on their own). RS will also freeze my service if I cannot be reached by phone and/or email. I understand that RoommateShop® is not responsible for the behavior or claims of its customers.

ROOMMATE SELECTION:

I understand that the information provided to me by RS about potential roommates is not guaranteed and it is my responsibility to verify the information prior to leasing to or from them. The privilege and sole responsibility of final selection, acceptance, or rejection of a roommate is to be mine.

BACKGROUND CHECKS:

I understand that RS has not conducted a prior criminal or credit check on potential roommates and that one can be done at my request for an additional fee in most cases. By using this service, I understand that RS may conduct a criminal background check on me if requested by any potential roommate.

RELEASE/INDEMNITY/DAMAGE LIMITATION: To the maximum extent allowed by law, I release RS, its employees, and agents from all liability of any kind and indemnify them harmless from any claims or demands based upon this agreement or upon any act or omission connected, herewith, past, present, or future, and, in any event, agree that the maximum amount of damages recoverable shall be the sum paid by me to RS for services hereunder. Although the information I provide RS is for the purpose of obtaining/becoming a roommate, and is expected to be revealed for said connection, RS may be required to disclose such information for any lawful/legal purpose.

Further, I attest to RS and its Clients that I do not deal drugs and have never been convicted of a violent crime, and that the information I have provided herein is true and correct to the best of my knowledge.
